Acceptance of Terms

By inviting Festie to your Discord server or using its features, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use Festie.

These Terms may be updated from time to time. Continued use of Festie after any such changes constitutes your acceptance of the new Terms.

Description of Service

Festie is a Discord bot designed to help servers celebrate birthdays. The bot provides birthday reminder functionality, customizable birthday messages, and birthday role assignment capabilities.

Festie only collects the minimum data necessary to function (Discord user ID, month and date of birthdays, and server configuration). All data is privately stored and is never shared with third parties. User data is automatically removed when using the /birthday remove command, when leaving a server, or when the bot is removed from a server.

While we strive to provide uninterrupted service, we cannot guarantee that the service will be available at all times. Festie may experience downtime for maintenance or due to technical issues.

User Responsibilities

As a user of Festie, you agree to:

• Use the bot in compliance with Discord's Terms of Service
• Not use Festie for any illegal purposes or to violate any laws
• Not attempt to exploit, harm, or extract data from Festie beyond its intended functionality
• Provide accurate information when setting up the bot
• Be responsible for all activities that occur under your server's use of Festie

Server administrators are responsible for ensuring that Festie is used appropriately within their Discord servers.

Intellectual Property

Festie and all of its content, features, and functionality are owned by Festie's developers and are protected by international copyright, trademark, and other intellectual property laws.

You may not:

• Reproduce, distribute, or create derivative works based on Festie
• Use the Festie name, logo, or branding without permission
• Attempt to reverse engineer or access the underlying code of Festie

Limitation of Liability

Festie is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that Festie will always be safe, secure, or error-free, or that it will function without disruptions, delays, or imperfections.

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use of or inability to use Festie
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from Festie
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through Festie

Indemnification

You agree to defend, indemnify, and hold harmless Festie's developers, administrators, and partners from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of Festie, or your violation of these Terms.

Termination

We reserve the right to terminate or suspend access to Festie for any server or user, at our sole discretion, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms.

You may terminate your use of Festie at any time by removing the bot from your Discord server.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Festie's developers operate, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within this jurisdiction.
